EB3 Visa
Employment-Based Immigration: Third Preference

You may be eligible for this immigrant visa preference category if you are a skilled worker, professional, or other worker. Currently, most countries only have a year to two year waiting period. You can check the visa bulletin for your country here.
Many companies have difficulty finding qualified employees. This process not only helps the company grow, but gives employees and their families a pathway to a green card. So many individuals do not know about this pathway to residency. We do not have to wait for a family based petition. Your hard work and dedication to your education or expertise can help you achieve that American Dream.
You can apply from abroad or from within the United States. However, if you do apply from within the United States, you must either have current status and will continue to have status until you are approved, or you have a 245i grandfathering document with no immigration issues. We can help you, and the company you work for, with this process that can be complicated and time sensitive. Call us today.

Skilled Worker“Skilled workers” are persons whose jobs require a minimum of 2 years training or experience, not of a temporary or seasonal nature. The skilled worker must meet the educational, training, or experience requirements of the job opportunity. Relevant post-secondary education may be considered as training.
Examples of EB-3 category employment are certain types of computer and technical workers (not researchers or managers), chefs, construction first-line supervisors, stonemasons, reporters and journalists, graphic designers, and fashion designers. If the person has done postsecondary training in the field, that can be counted as training. |
Professionals“Professionals” are persons whose job requires at least a U.S. baccalaureate or foreign equivalent degree and are a member of the professions.
Professionals include such occupations as architects, lawyers, physicians, engineers, and teachers. Aside from these examples of "professions," U.S. Citizenship and Immigration Services (USCIS) tends to accept workers with a university degree who are working in their field of expertise. |
Other Workers/Unskilled
The “other workers” subcategory is for persons performing unskilled labor requiring less than 2 years training or experience, not of a temporary or seasonal nature.
Housekeepers, nannies, janitors, garden workers, nurse's aides, and farm workers are among the likely applicants. Of course, the worker's own qualifications must satisfy whatever requirements the job does normally have, or the person will not be granted a green card under this EB-3 subcategory. |
